They have the ability to do so easily. Bill & Betty School o' Vet Medicine in Glendo, Wyoming could not afford to do so. They also don't have law firms (or in house lawyers) already working for them. When NYC and LA and Chicago join in a lawsuit (over say tobacco) it could be framed as big cities, but the benefit carries far and wide.

A study by Cornell came to the conclusion that it is safer to stay open:

A study by Cornell researchers concluded that with nominal parameters, an in-person semester would result in 3.6 percent of the campus population (1,254 people) becoming infected, and 0.047 percent (16 people) requiring hospitalization. An online semester, they concluded, would result in about 7,200 infections and more than 60 hospitalizations.

My university (big but not elite state school) will do a shortened semester that ends before Thanksgiving. If the students don't travel home for fall break or turkey day, it should probably be safer.

Berkeley students planning fraudulent course to circumvent ICE rules, avoid deportations
From what I have read, the plan is not to have a fraudulent course. Rather one that is Faculty sponsored, with a syllabus, under a department, and requires attendance. Having it under the Anthro dept makes sense.
Some schools are looking at outdoor Phys Ed. classes to meet the requirement.

Cute, but ICE can simply tighten the new regs. to e.g. "the majority of classroom tuition time must be in person".

At least in warm-weather states, open-air or under-large-canopy outdoor classrooms with distancing and mask-wearing strictly enforced would seem a viable option.
